Priority for
Service (PFS)

As stated in the Every Student Succeeds Act (ESSA) – 1304(d) PRIORITY FOR SERVICES statute, when providing services with Title I, Part C funds, LEAs must give priority to eligible migratory children who have made a qualifying move within the previous one-year period and who

(1) are failing, or most at risk of failing, to meet the challenging State academic standards; or
(2) have dropped out of school.

The Texas Education Agency provides an overview of the PFS Implementation Process.

PFS Responsibilities

PFS Action Plan

The PFS Action Plan articulates the criteria for addressing the plan for PFS students’ success, including timelines for achieving stated goals and objectives.

The Title I, Part C Coordinator or MEP staff will include the PFS Action Plan in the District Improvement Plan (DIP) as a separate section appropriately labeled or identified (e.g., “MEP PFS Action Plan Section”). The action plan elements should not be integrated with other DIP sections that focus on other student population groups (e.g., Emergent Bilingual, economically disadvantaged).

SSA Member Districts

It is the responsibility of the ESC serving as the fiscal agent to collaborate with the SSA Member Districts to create and implement a plan for serving PFS students within the SSA Member Districts’ boundaries.

  • If the ESC creates the PFS Action Plan for the entire SSA, the ESC must send the PFS Action Plan to SSA Member Districts to include in the migrant-specific section of the DIP.
  • If each SSA Member District creates the PFS Action Plan, a copy must be sent to the ESC.

ESC Responsibilities

It is the responsibility of the ESC serving as the fiscal agent to collaborate with the SSA Member Districts to create and implement a plan for serving PFS students within the SSA Member Districts’ boundaries.

Additionally, ESCs are required to

  • Train all Independent Project Districts in the development and implementation of the district-specific PFS Plan
  • Review all Independent Project Districts’ PFS Action Plans to ensure accuracy and completeness. This must be completed before the end of September
  • Ensure inclusion of the PFS Plan into the DIP
  • Monitor throughout the year via the PFS Tracking Report on TX-NGS to ensure LEAs are running the required monthly PFS reports.
